Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using Fairway Fantasy Golf (the "App") operated by FairwayFGL, Inc. ("Company," "we," "us," or "our").

1. Acceptance of Terms

By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 18 years old to use this App. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Description of Service

Fairway Fantasy Golf is a free-to-play fantasy golf application that allows users to create and participate in fantasy golf leagues based on PGA Tour events. No real money wagering is involved. The App is for entertainment purposes only.

4. User Accounts

To use certain features of the App, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update your information as necessary.

5. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Interfere with or disrupt the App or servers
• Attempt to gain unauthorized access to any part of the App
• Use any automated means to access the App
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Engage in any activity that could damage or impair the App

6. Intellectual Property

The App and its original content, features, and functionality are owned by the Company and are protected by copyright, trademark, and other intellectual property laws. PGA Tour and golfer names, likenesses, and statistics are used for informational and entertainment purposes only.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the App or violation of these Terms.

10. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Texas.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms in the App. Your continued use of the App after changes constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
